Before booking with us, you must ensure that you have read and understood these terms and conditions and raise any questions that you may have with us. By asking us to confirm your booking you are accepting the terms and conditions laid out below on behalf of yourself and all persons who are traveling with you.
Terms and Conditions for Bon Joyage, LLC
These Terms and Conditions (“Terms”) govern the relationship between Bon Joyage, LLC (“Bon Joyage,” “we,” “us,” or “our”) and you, the purchaser and/or traveler (“Client,” “you,” or “your”). By requesting a booking with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms on behalf of yourself and all persons traveling with you. These Terms include important limitations of liability, disclaimers, and indemnity provisions that may affect your legal rights.
1. Client Responsibilities
You represent and warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. You agree to be financially responsible for all travel arrangements made on behalf of yourself and any members of your party. You further warrant that all information provided by you is accurate and complete.
You are solely responsible for obtaining and maintaining valid travel documentation, including passports, visas, and health/vaccination certificates. Passports must be valid for at least six (6) months beyond your return date. Some countries may require additional forms of identification. For up-to-date travel requirements, consult the U.S. Department of State at www.travel.state.gov, the Centers for Disease Control and Prevention, and the International Society of Travel Medicine.
2. Booking and Pricing
All quotes are subject to availability and are not guaranteed until full payment is received. Prices quoted in foreign currencies are subject to exchange rate fluctuations and may incur foreign transaction fees. We will make reasonable efforts to honor quoted prices, but suppliers may impose additional charges due to cost increases beyond our control.
You are responsible for providing accurate legal names that match your travel identification. We are not liable for costs incurred due to incorrect or incomplete information provided by you.
3. Client Conduct
By booking with Bon Joyage, you accept responsibility for any damage or loss caused by you or your party. Full payment for such damage or loss (reasonably estimated if not precisely known) must be made directly to the supplier at the time of the incident. You agree to indemnify and hold harmless Bon Joyage from any claims (including legal fees) arising from your conduct.
We reserve the right to remove any client from a trip or activity if their behavior endangers themselves or others, disrupts the experience of other travelers, or violates the policies of our suppliers. No refunds will be issued in such cases. Baggage and personal effects are your sole responsibility at all times.
4. Assumption of Risk
You acknowledge that travel involves inherent risks, including but not limited to injury, illness, theft, delays, and unforeseen events. By participating in any trip arranged by Bon Joyage, you voluntarily assume all such risks and agree that Bon Joyage shall not be held liable for any resulting loss, damage, or injury.
5. Travel Insurance
We strongly recommend that you purchase comprehensive travel insurance, including coverage for trip cancellation, medical expenses, personal liability, and loss of baggage. Unless you purchase a “cancel for any reason” policy, most insurance policies contain exclusions. You agree to hold Bon Joyage harmless for your decision not to purchase insurance or for any denied claims.
6. Third-Party Suppliers
Bon Joyage acts solely as an agent for independent travel suppliers. Your travel arrangements are subject to the terms and conditions of those suppliers, including their cancellation and change policies. We do not control or operate the services provided by these third parties and are not liable for any act, omission, or negligence on their part.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BON JOYAGE’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR TRAVEL ARRANGEMENTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN FEES OR COMMISSIONS FOR THOSE ARRANGEMENTS. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR ENJOYMENT.
8. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bon Joyage, its officers, employees, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising out of your actions, omissions, or breach of these Terms.
9. Force Majeure
Bon Joyage shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, natural disasters, labor strikes, government actions, or failures of communication systems. In such cases, we will make reasonable efforts to provide alternative arrangements, but refunds are not guaranteed.
Suppliers may also invoke their own force majeure clauses and may cancel or modify services at their discretion. Any refunds or credits issued will be subject to the supplier’s policies.
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Colorado, USA. Any dispute arising under or relating to these Terms or your travel arrangements shall be resolved exclusively by binding arbitration in Denver, Colorado, pursuant to the Federal Arbitration Act and the rules of the American Arbitration Association (AAA) or Judicial Arbitration and Mediation Services (JAMS). By agreeing to these Terms, you waive your right to a jury trial.
11. Changes to Terms
Bon Joyage reserves the right to update or modify these Terms at any time without prior notice. The most current version will be posted on our website and will become effective immediately upon posting.
